HB INSIDER CLUB Membership Terms & Conditions

Thank you for using this service, which is owned by Haley Bogaert Face Inc. (“HB Face”, “we”, “us”, or “our”)

1. Introduction

These Terms & Conditions (“Terms”) govern your participation in the HB INSIDER CLUB (“Membership Program”) offered by HBFace. By enrolling in the Membership Program (or, if you are a minor, by having your parent or guardian join on your behalf), you agree to comply with these Terms outlined herein.

By agreeing to these Terms, you also agree to the terms of our Privacy Policy, which is expressly incorporated herein. Before signing up for the Membership Program, please carefully review our Privacy Policy. All information provided to us will be handled in accordance with our Privacy Policy. To the extent there are inconsistencies between these Terms and our Privacy Policy, these Terms control.

2. Annual Membership Commitment

• A 1-Year Annual Membership commitment paid in equal monthly installments.
• It is non-refundable, non-cancelable, and non-transferable once purchased.
• Benefits and pricing are valid for the 12-month term following enrollment.

4. Membership Billing & Payment

• Annual Membership: The membership is a commitment for 1 year and the membership fee will be billed on a monthly basis on the 1st of each month for 12 months.
• Non-Refundable: All membership fees are non-refundable, including for any unused services or periods of inactivity.
• Payment Method: Members authorize HBFace to automatically charge their selected payment method for all applicable fees. It is the member’s responsibility to ensure payment details are current and valid.
• Payment Authorization: By joining the Membership Program and by providing a credit card or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third party payment processor) to charge your payment method for all charges you incur for the purchase of the membership on a recurring basis (including any applicable taxes and other charges) (each such purchase, an “Order”). You are responsible for, and agree to pay, all such charges. If we or our third party payment processor cannot obtain authorization for charges to your payment method or if any amounts you authorize us to charge to your payment method are reversed or charged back for any reason, we may, at our option, in addition to any other remedies: cancel or suspend any undelivered portion of your Orders, make second and/or subsequent attempts to charge your payment method, and/or use any other lawful means to collect payment on any outstanding amounts due to us. You will remain responsible to pay all applicable charges for all Orders. You agree to provide and keep current a valid payment method. However, your failure to do so shall not constitute cancellation of any Order. In the event you want to change or update payment information, you can do so at any time by sending us an email. Any applicable taxes and other charges, if any, are additional. We reserve the right to change our membership and other product offerings, and to adjust prices as we may determine in our sole discretion, at any time and without notice; provided, however, that if we change the amounts or other charges associated with your then-current membership, we will provide advance notice of such changes. We will not, however, be able to notify you of changes in any applicable taxes prior to such changes becoming effective. This authorization remains effective until your membership is canceled or otherwise terminated in accordance with these Terms.

5. Appointment & Cancellation Policy

24-Hour Cancellation Requirement: Appointments must be canceled or rescheduled at least 24 hours in advance.

No-Shows & Late Cancellations:

• Cancellations made less than 24 hours in advance are subject to a 50% service fee.
• Complimentary services missed or canceled late will be subject to a $50 cancellation fee.

Arriving Late: Arrivals 15 minutes or more after the appointment time may be treated as a no-show and are subject to the same cancellation policy.

6. Membership Cancellation & Termination

• Non- refundable for the 12-month term.           
• Will automatically expire at the end of the 12 months unless renewed.

HBFace Termination Rights

HBFace reserves the right to terminate a membership immediately for:

• Failure to pay fees
• Misconduct or violation of HBFace’s policies as may be in force from time to time (including but not limited to abusive language, inappropriate behavior, or repeated no-shows)     
• Any breach of these Terms
• No refund will be issued in the event of termination due to misconduct or unpaid fees.

7. Program Modifications & Termination

• HBFace may adjust membership pricing, benefits, services, or these Terms at its discretion with 30 days’ advance notice to members.
• Changes will not apply retroactively to active annual memberships but may apply upon renewal.
• If HBFace discontinues the Membership Program or any location, members will be notified and may not be entitled to refunds for unused services or remaining membership terms, unless required by applicable laws.

8. Privacy & Data Use

By enrolling, you consent to HBFace’s collection, use, and storage of your personal information in accordance with our      Privacy Policy located at:      https://hbface.com/pages/privacy-statement. 

We are committed to safeguarding your personal data and comply with applicable privacy laws in Ontario and Canada.

9.  Acceptance of Terms

By enrolling in the Membership Program, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full.

1. Governing Law and Dispute Resolution

These Terms, and any related disputes or claims, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. By enrolling, you agree that any legal proceedings will be handled in accordance with Ontario law and in Ontario courts.

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER BASIS.
3. IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED TEN DOLLARS ($10.00).
4. Some jurisdictions do not allow certain kinds of limitations or exclusions of liability, so the limitations and exclusions set out in these Terms may not apply to you. Other jurisdictions allow limitations and exclusions subject to certain conditions. In such a case the limitations and exclusions set out in these Terms shall apply to the fullest extent permitted by the laws of such applicable jurisdictions.

HB INSIDER CLUB Membership Terms & Conditions

By enrolling in the Membership Program (or, if you are a minor, by having your parent or guardian join on your behalf), you agree to comply with these Terms outlined herein.

By agreeing to these Terms, you also agree to the terms of our Privacy Policy, which is expressly incorporated herein. Before signing up for the Membership Program, please carefully review our Privacy Policy.

All information provided to us will be handled in accordance with our Privacy Policy. To the extent there are inconsistencies between these Terms and our Privacy Policy, these Terms control.

2. Annual Membership Commitment

A 1-Year Annual Membership requires a one-time upfront payment at the then-current annual rate (the current rate is $135 + HST). The membership is non-refundable, non-cancelable, and non-transferable once purchased, subject to the cooling-off period described in Section 3 below. Benefits and pricing are valid for the 12-month term following enrollment. HBFace reserves the right to adjust the annual membership rate at any time. Any price changes will take effect at your next renewal and will be communicated to you via email at least 30 days before your renewal date. The membership rate in effect at the time of your enrollment or renewal will apply for the duration of that 12-month term.

3. Membership Billing & Payment

Initial Payment: Your membership fee is charged in full at the then-current annual rate at the time of enrollment.

Automatic Renewal: To ensure uninterrupted access to your membership benefits, your membership will automatically renew at the end of each 12-month term. Upon renewal, your membership will be charged at the then-current annual membership rate, which may differ from your original enrollment rate. By enrolling and providing a valid payment method, you authorize HBFace (or our third-party payment processor) to charge your payment method on file for the applicable renewal fee, including any applicable taxes, on or after your renewal date.

Renewal Notice: We will send you a renewal reminder via email at least 30 days before your renewal date. This reminder will confirm your renewal date, the renewal price, and instructions for opting out. Subject to applicable consumer protection laws, you may be entitled to a 10-day grace period following your renewal charge during which you may cancel the renewal and receive a full refund without penalty. For more information on your cancellation rights, please contact us at membership@hbface.com.

Opting Out of Renewal: You may opt out of automatic renewal at any time by contacting us at membership@hbface.com 14 days before your renewal date. If you opt out, your membership will remain active until the end of your current 12-month term and will not renew.

Failure to Notify: If we fail to send the renewal reminder within the 30-day timeframe described above, a 10-day grace period will be provided following the renewal charge, during which you may request to cancel the renewal and receive a full refund of the renewal fee.

Failed Renewal Payments: If we are unable to process your renewal payment, we will notify you by email and provide a 14-day grace period to update your payment information. During the grace period, your membership benefits will remain active. If payment is not received within 14 days, your membership will be canceled and benefits will cease immediately. We may attempt to charge your payment method up to two additional times during the grace period.

Payment Authorization: By providing a credit card or other accepted payment method, you represent and warrant that you are authorized to use that payment method. You authorize us to charge it for all membership fees on a recurring basis, including applicable taxes and other charges. If we cannot obtain authorization, or if any charges are reversed or charged back for any reason, we may, at our option: cancel or suspend your membership, make additional attempts to charge your payment method, and/or use other lawful means to collect outstanding amounts. You will remain responsible for all applicable charges.

You are responsible for keeping a valid payment method on file. Your failure to maintain a valid payment method does not constitute cancellation of your membership. To update your payment information at any time, email us at membership@hbface.com.

Price Changes: We reserve the right to adjust the annual membership rate at any time. However, any price change affecting your renewal will be communicated to you via email at least 30 days before your renewal date. The new rate will take effect at your next renewal — it will not apply retroactively to your current membership term. We are unable to provide advance notice of changes in applicable taxes.

4. Membership Benefits

Welcome Offer:

• Enjoy your first brow threading on us — a $40 value.
• Pick from Lip Crayon #01, Lip Crayon #05, or Lip Crayon #07 — a $27 value.

Welcome offer items must be redeemed within 90 days of your enrollment date. The complimentary brow threading cannot be carried forward or exchanged for cash. The Lip Crayon is a one-time gift provided at enrollment while supplies last and cannot be exchanged or substituted. Welcome offer items (including specific products and values) are based on availability at the time of enrollment and may change for future enrollees.

Member Discounts: Save 10% on services and 20% on in-store products all year. Discounts cannot be combined with other promotional offers unless expressly stated in writing by HBFace. This restriction does not apply to the Bundle & Save benefit described below. If, at any point during your membership period, we are offering a larger discount to the general public on the same service or product, you will receive whichever single discount is greater.

Expert Consultation: Get a personalized skincare and makeup consultation with an HBFace expert every quarter. Consultations must be booked and completed within the applicable calendar quarter. Unused consultations do not carry forward to future quarters.

Bundle & Save: Stack your membership discount with service bundles for even more savings. Bundle pricing and availability may vary by location.

Changes to Benefits: HBFace reserves the right to modify, replace, or discontinue specific membership benefits (including welcome offer items, discount percentages, and consultation formats) at any time. Changes will apply to new enrollments and renewals. Members in an active 12-month term will continue to receive the benefits in effect at the time of their enrollment or most recent renewal for the remainder of that term, unless a change provides an enhanced or additional benefit, in which case it may be applied immediately.

Membership benefits may vary by location and are subject to availability.

5. Appointment & Cancellation Policy

Cancellations within 48 hours of your appointment will incur a 50% service fee. 

Cancellations within 24 hours of your appointment will incur a 100% service fee.

No-Shows: A fee equal to a percentage of the scheduled service will be charged to the card on file.

Arriving Late: Arrivals 15 minutes or more after the appointment time may be treated as a no-show and are subject to the same cancellation policy.

6. Membership Cancellation & Termination

Memberships are non-refundable for the 12-month term, subject to the cooling-off period described in Section 3.

Memberships will automatically renew unless canceled prior to the renewal date.

Termination by HBFace: We may terminate your membership immediately, without refund, if you:

• Engage in misconduct or violate HBFace's policies as may be in force from time to time (including but not limited to abusive language, inappropriate behavior, or repeated no-shows);
• Breach any provision of these Terms; or
• Have unpaid fees or outstanding balances on your account.

No refund will be issued in the event of termination due to misconduct, breach, or unpaid fees.

Voluntary Cancellation: You may choose not to renew your membership by opting out of automatic renewal. Opting out does not entitle you to a refund for any remaining portion of your current 12-month term. Your membership benefits will remain active until the end of your current term.
